Terms and Conditions of Sale

These Terms and Conditions apply to all purchases made from Square Motorcycle Parts, a trading name of Yellow Square Enterprises Ltd ("we", "us", "our").

By placing an order with us, you agree to be bound by these Terms and Conditions.


1. Orders and Contract Formation

When you place an order with us, you are making an offer to purchase goods.

A contract between you and us is only formed when we accept your order by dispatching the goods or otherwise confirming acceptance. Payment being taken does not necessarily constitute acceptance of your order.

We reserve the right to refuse or cancel any order before dispatch for reasons including, but not limited to:

  • Stock shortages

  • Pricing errors

  • Product discontinuation

  • Suspected fraud

  • Incorrect product information

  • Any other genuine commercial reason

If we cancel your order, a full refund will be issued using your original payment method.


2. Product Information

We make every effort to ensure product descriptions, specifications and photographs are accurate.

Product images are provided for illustrative purposes only. Manufacturers may alter the appearance, finish, branding or packaging of products without prior notice. Such changes will not affect the intended function or fitment of the product unless otherwise stated.

Unless otherwise specified:

  • All products are aftermarket replacement parts.

  • Aftermarket parts may differ in appearance from original equipment manufacturer (OEM) parts.

  • All products are intended for UK specification motorcycles, scooters and quad bikes.

Where model years are listed, they refer to the manufacturer's model year rather than the vehicle's registration year.


3. Vehicle Compatibility

Vehicle compatibility information, application lists and product descriptions are provided as a guide only.

It is the customer's responsibility to ensure that the part is suitable for their specific vehicle before installation. Customers should compare photographs, dimensions, specifications and OEM part numbers where applicable.

We cannot accept responsibility for incompatibility where a product has been purchased without suitable checks being made.


4. Installation

We strongly recommend that all parts are installed by a suitably qualified motorcycle mechanic following the vehicle manufacturer's workshop manual and all applicable safety procedures.

Electrical components must always be tested before installation where possible.

We are not responsible for damage, failures or safety issues arising from:

  • Incorrect installation

  • Incorrect adjustment

  • Improper maintenance

  • Modification of the product

  • Use outside of the manufacturer's intended purpose

  • Installation by an unqualified person

  • Failure to follow manufacturer or workshop manual instructions

We recommend retaining all invoices and documentation relating to installation work.


5. Returns and Cancellation

Consumers have the right to cancel their order within 30 days of receiving their goods.

Once cancellation has been requested, goods must be returned within 14 days.

Unless the goods are faulty, incorrectly supplied or otherwise required by law, return postage costs are the responsibility of the customer.

Returned items must be:

  • unused;

  • uninstalled;

  • complete;

  • in their original packaging where reasonably possible; and

  • in a resaleable condition.

We may reduce any refund where returned goods have been handled beyond what is necessary to establish their nature, characteristics or function.

Where applicable, the following charges are non-refundable and may be deducted from any refund due:

  • Any postage or shipping charges paid at the time of purchase, other than the standard outbound UK delivery charge where refundable under applicable consumer law.
  • Any duty prepaid, import taxes or customs clearance charges paid by us on the customer's behalf in relation to the original shipment.
  • Any customs duties, taxes, handling fees or import charges incurred when receiving a returned international parcel where the parcel has not been correctly declared as a returned item.
  • Any surcharges, administration fees or additional carriage charges imposed by the delivery carrier as a result of, including but not limited to:
    • insufficient postage being paid by the sender;
    • oversized or overweight parcels;
    • incorrect packaging;
    • failure to declare the parcel correctly for customs purposes;
    • failure to mark an international return as a returned item; or
    • any other charges incurred due to the manner in which the return was sent.

Any such costs incurred by us may be deducted from the refund payable or, where no refund is due, charged to the customer.

Nothing in this section affects your statutory rights.


6. Faulty Goods

If you believe a product is faulty, please contact us before carrying out any repairs, modifications or disposal of the goods.

We may request that the goods are returned for inspection.

Returned products may be inspected by us and/or submitted to the manufacturer for independent testing.

Where a product is confirmed to be faulty due to a manufacturing defect, we will, at our discretion:

  • repair the product;

  • replace the product; or

  • provide a full or partial refund in accordance with your statutory rights.

Where a fault is confirmed and reported within 30 days of delivery, we will reimburse reasonable return postage costs.

After 30 days, customers are responsible for return postage unless otherwise required by law.

If testing determines that the product is not faulty, was incorrectly installed, modified, damaged through misuse or is otherwise outside warranty conditions, return postage costs remain the responsibility of the customer.


7. Labour and Associated Costs

Our liability is limited to the repair, replacement or refund of the goods as appropriate.

We do not accept liability for:

  • labour charges;

  • workshop costs;

  • diagnostic charges;

  • vehicle recovery;

  • vehicle hire;

  • loss of earnings;

  • loss of use;

  • inconvenience; or

  • any indirect or consequential loss,

except where such liability cannot legally be excluded under applicable law.


8. Delivery

Delivery dates are estimates only and are not guaranteed.

We shall not be liable for delays caused by circumstances beyond our reasonable control, including but not limited to:

  • courier delays;

  • customs inspections;

  • adverse weather;

  • industrial action;

  • supplier delays;

  • transport disruption; or

  • force majeure events.

Unless otherwise stated, all costs of importing into a country outside of the UK will be the responsibility of the buyer. This includes but is not limited to:

  • Import VAT
  • Import Duty
  • Admin Fees

9. Safety

If you believe a part supplied by us may be faulty or unsafe, you should stop using the vehicle immediately where it is safe to do so and contact us before undertaking any repairs or modifications.

Continued use of a suspected faulty product may affect our ability to investigate the issue and determine the cause of failure.


10. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;

  • fraud or fraudulent misrepresentation; or

  • any liability which cannot lawfully be excluded or limited.

Subject to the above, our total liability arising from any claim relating to goods supplied shall not exceed the purchase price paid for those goods.


11. Privacy

Any personal information supplied to us will be processed in accordance with our Privacy Policy and applicable UK data protection legislation.


12. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.


13. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and us relating to the sale of goods and supersede any previous agreements, representations or understandings except where required by law.
